OUR REFUND POLICY

AbuData ("we," "us," or "our") provides software development, web development, mobile application development, and design consultancy services. This Refund Policy governs all payments made in connection with our services. By engaging our services and signing a proposal or contract with AbuData, you agree to the terms of this Refund Policy.

1. No Refund Policy (Post-Contract Signing)

Once a client has signed a proposal, contract, or any written agreement authorizing the commencement of work, all payments made are strictly non-refundable. This applies regardless of the stage of project completion at the time of any refund request. The execution of a contract constitutes a binding agreement, and AbuData immediately begins allocating resources, time, and expertise upon contract signing.

2. Project Cancellation During Implementation

If a client chooses to cancel a project after work has commenced — at any stage of implementation, including discovery, design, development, or testing — all payments made up to the point of cancellation will not be refunded. This includes:

• Initial deposits or retainer fees
• Milestone payments already processed
• Advance payments or partial payments made prior to cancellation
• Payments made for discovery, planning, or design phases

3. Cancellation Notice Procedure

To initiate a project cancellation, the client must notify AbuData in writing via email at info@abudata.co. The cancellation takes effect upon written acknowledgment by AbuData. Cancellation of a project does not relieve the client of any outstanding payment obligations as outlined in the signed contract. AbuData reserves the right to invoice for any work completed or in progress at the time of cancellation.

4. Payment Provider Compliance

This Refund Policy has been designed to be compliant with major payment processors and networks, including but not limited to Visa, Mastercard, and bank transfer services or any other payment providers. By engaging our services and signing a contract, clients explicitly acknowledge and agree to this Refund Policy prior to any payment being processed. This acknowledgment serves as the primary basis for dispute resolution with payment providers. In the event of a payment dispute or chargeback initiated with any payment provider, AbuData reserves the right to provide documentation of the signed contract, proposal, and this Refund Policy as evidence that the client was fully informed of and consented to these terms prior to payment.

5. Scope of Services Covered

This Refund Policy applies to all services provided by AbuData, including but not limited to:

• Web development and design
• Mobile application development
• Custom software development
• UI/UX design and prototyping
• SaaS solutions and integrations
• Data management and analytics solutions
• Consultancy, discovery, and strategy services
• Any other digital or technical services offered by AbuData

6. Exceptional Circumstances

AbuData understands that unforeseen circumstances can arise. In the rare event that AbuData is unable to deliver the agreed-upon services due to circumstances solely and directly attributable to AbuData, we will engage in good faith negotiations with the client to reach a fair resolution. Such resolution may include a partial credit toward future services with AbuData. Any resolution will be evaluated on a case-by-case basis at the sole discretion of AbuData management and does not constitute a precedent for future disputes.

7. Governing Law

This Refund Policy is governed by the laws of Sultanate of Oman. Any disputes arising out of or in connection with this policy shall be resolved in accordance with the dispute resolution provisions set forth in our Terms & Conditions, available at https://www.abudata.co/terms.
